Terms of Service

1. Who you are contracting with

These terms are between you and BAGS TO GO ENTERPRISES, LLC, a limited liability company organised under the laws of the State of Florida, trading as Passfold, of 4050 SW 11th Terrace, Fort Lauderdale, FL 33315, USA(“we”, “us”). By placing an order you accept these terms, our Privacy Policy, our Refunds, Returns & Cancellation Policy and our Shipping & Delivery Policy.

2. Age

You must be at least 18 to place an order. Nobody under 13 may use this site. Between 13 and 17 you may use it only with the consent of a parent or guardian, who is then the contracting party and responsible for payment.

3. What we sell

Small leather articles for carrying travel documents: passport covers, document folios, luggage tags, cable and technology rolls, small pouches, and sets of those articles. Nothing we sell is larger than A5. We do not sell luggage, bags or wallets.

Every article page states the hide, the leather grade in the vocabulary of the Federal Trade Commission’s guides for leather products, the tanning method, the surface finish, the measured dimensions, the measured thickness when empty, the empty weight and the pockets and slots. Where an article contains split leather, that is stated in plain words on the article page. We do not use bonded leather.

Natural variation

Leather is a natural material. Grain, shade, growth wrinkles, healed insect marks and range scars vary between hides and between panels of the same article. These are characteristics of the material, not defects. Uncoated vegetable-tanned articles darken and mark with use; that change is expected and is described on each such article page and in Materials & Care.

What we do not claim

Where an article includes a shielding layer, we state the construction, the frequency at which it was measured and the conditions of that measurement. We make no claim that any article prevents theft, fraud, unauthorised reading or misuse of your documents or cards, and nothing on this site should be read as such a claim. No article is waterproof, scratch-proof or indestructible, and we offer no lifetime guarantee.

Photographs are of the articles we sell but are representations: colour reproduction varies between screens, and no two hides are identical.

4. How an order is formed

1. You add articles to your cart and complete the delivery details at checkout.
2. You are shown the full amount payable — goods, shipping and any tax we are required to collect — before you commit to anything.
3. Submitting the order is an offer to buy. We record it and send an acknowledgement with a reference number. That acknowledgement is not acceptance.
4. The contract is formed when we confirm dispatch. Until then we may decline the order — for example if an article is out of stock, if a price was displayed incorrectly, if we cannot deliver to the address, or if we suspect fraudulent use of a payment method. If we decline after payment, we refund in full.

5. Prices and currency

All prices, charges and refunds on this site are in United States Dollars (USD). There is no other currency and no currency switch: if your card is denominated in another currency, your bank converts at its own rate and may add its own fee, over which we have no control.

Prices exclude sales tax. Where we are required to collect sales tax it is calculated and shown at payment. For deliveries outside the United States, import duties, customs charges and local taxes are payable by the recipient and are not included in anything we charge — see the Shipping & Delivery Policy.

Free standard shipping within the contiguous United States applies to orders of USD 69.00 or more, calculated on the goods total before tax.

Promotions and reference prices

Where a discount code or promotion applies, its conditions and end date are stated wherever it is offered. Codes are not combinable unless we say so and have no cash value. Where we show a struck-through reference price, that price is the lowest price at which we actually offered the article in the 30 days before the reduction. We do not display invented reference prices.

6. Payment

Payment is taken in United States Dollars (USD) through a payment provider that is certified to PCI-DSS Level 1. Card details are entered on that provider’s page. We never receive, process or store your full card number, expiry date or security code.

We accept the card schemes shown at checkout. Your payment is authorised at the time you pay and is captured when we dispatch, or earlier where your payment method requires it. If a payment is reversed or fails after dispatch, the goods remain our property until paid for in full.

If you do not recognise a charge, please contact us before raising a chargeback — we can usually identify and resolve it the same day, and a chargeback raised in error costs you time you do not need to spend.

7. Delivery and risk

Dispatch, carriers, destinations and delivery times are set out in the Shipping & Delivery Policy. Risk in the goods passes to you on delivery to the address you gave us. Title passes when we have received payment in full.

8. Returns

Your right to cancel and return is set out in the Refunds, Returns & Cancellation Policy, which forms part of these terms. Nothing in these terms limits any statutory right you have as a consumer.

9. Acceptable use of this website

You agree not to:

• place orders fraudulently or using a payment method you are not authorised to use;
• attempt to gain unauthorised access to any part of the site or its infrastructure;
• scrape, mirror or systematically extract the site, or use it to train a model without our written permission;
• copy our photographs, text or the Passfold name and mark for your own commercial use;
• use the contact forms to send unsolicited commercial messages.

We may suspend or refuse service to anyone who does. All content on this site, including photographs and copy, is our property or licensed to us and may not be reproduced without permission. The Passfold name and fold mark are ours.

10. Our liability

We are responsible for loss you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable, for loss caused by an event outside our reasonable control, or for business loss — these articles are sold for personal use.

Except where the law does not allow it, our total liability arising out of or in connection with any order is limited to the amount you paid for that order. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded.

11. Events outside our control

We are not liable for delay or failure caused by an event outside our reasonable control, including carrier disruption, customs action, extreme weather, industrial action, or failure of public networks. If such an event materially delays your order we will tell you and you may cancel and receive a full refund.

12. Complaints and disputes

Please contact us first at support@polarbearleathergoods.shop or +1 909 402 3517. We acknowledge complaints within one business day and aim to resolve them within ten. Most disputes end there.

13. Governing law

These terms and any dispute arising out of them are governed by the laws of the State of Florida, United States of America, without regard to its conflict of law rules. The state and federal courts located in Broward County, Florida have jurisdiction. If you are a consumer resident in the European Economic Area or the United Kingdom, this does not deprive you of the protection of mandatory consumer-protection provisions of the law of your country of residence, or of your right to bring proceedings there.

14. General

If any provision of these terms is found unenforceable, the rest continues to apply. Our failure to enforce a term is not a waiver of it. You may not transfer your rights under these terms without our written consent. These terms, together with the policies they refer to, are the entire agreement between us in relation to your order.

15. Changes

We may change these terms. The version that applies to your order is the version published when you placed it, and the effective date is shown at the top of this page.
